This year heralds the welcome arrival of the Consumer Insurance (Disclosure and Representation) Act which received Royal Assent in April 2012 and which has been introduced on the recommendation of the Law Commission to improve the balance between the duty of the consumer proposer for insurance (this does not apply to businesses) to volunteer "material information" and the obligation of the Insurer to ask questions about things that it believes to be "material".
